1. Acceptance of Terms

By accessing and using the Hitec Marine website ("Service") operated by NextGen Marine, LLC, doing business as HiTec Marine ("Hitec Marine", "us", "we", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

Hitec Marine provides professional marine electronics installation, maintenance, and repair services. We also sell marine electronics equipment and Ikon boats. Our services include:

  • Marine electronics installation (fish finders, GPS, radar, communication systems)
  • Full boat rigging and electrical work
  • Equipment maintenance and repair services
  • Sale of marine electronics and Ikon boats
  • Technical support and consultation

3. Service Terms and Conditions

3.1 Installation Services

  • All installation work is performed by factory-certified technicians
  • We guarantee workmanship for 12 months from completion date
  • Customer must provide safe working conditions and vessel access
  • Installation timeline estimates are approximate and subject to parts availability

3.2 Warranty

  • Equipment warranties are provided by manufacturers, not Hitec Marine
  • Installation workmanship is warranted for 12 months
  • Warranty does not cover damage from misuse, accidents, or normal wear
  • Customer must notify us of warranty claims within 30 days of discovery

3.3 Payment Terms

  • 50% deposit required for all installations over $500
  • Balance due upon completion of work
  • Payment accepted: cash, check, credit cards
  • Past due accounts subject to 1.5% monthly service charge

4. Limitation of Liability

Hitec Marine's liability is limited to the cost of services provided. We are not liable for:

  • Consequential, incidental, or punitive damages
  • Loss of use, profits, or business opportunities
  • Damage to vessel from pre-existing conditions
  • Equipment failure due to manufacturer defects
  • Force majeure events beyond our control

5. Customer Responsibilities

  • Provide accurate information about vessel and electrical systems
  • Disclose any previous modifications or damage
  • Ensure vessel is clean and accessible for work
  • Remove valuable items from work areas
  • Maintain insurance coverage on vessel during service

6. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Hitec Marine and protected by copyright laws. You may not reproduce, distribute, or create derivative works without written permission.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Modifications

Hitec Marine reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to this website. Continued use of our services constitutes acceptance of modified terms.

9. Governing Law

These terms are governed by the laws of the Commonwealth of Kentucky. Any disputes will be resolved in the courts of Marshall County, Kentucky.

10. SMS / Text Messaging Program

Hitec Marine offers a transactional SMS (text message) program for service customers. By providing your mobile number and opting in, you consent to receive service-related text messages from Hitec Marine.

10.1 Program Description and Message Types

Messages are limited to account notifications, including:

  • Appointment confirmations
  • Day-before and morning-of appointment reminders
  • "Your boat is ready for pickup" notifications
  • Reschedule notices and service status updates
  • Secure links to view or pay open invoices

This is not a promotional or marketing program. Hitec Marine does not sell, rent, or share your mobile number or SMS opt-in data with third parties for marketing purposes.

10.2 How You Opt In

You opt in to SMS notifications when you provide your mobile number while creating a service ticket, scheduling an appointment, or completing a service-request form (in person at our shop or via our website). At intake, you will see and agree to the following disclosure:

"By providing your mobile number, you agree to receive service-related text messages from Hitec Marine, including appointment confirmations, reminders, and pickup notifications. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Consent is not a condition of purchase."

Consent to receive text messages is not a condition of any purchase or service. We do not use purchased lists, third-party lead sources, or bulk-acquired numbers for this program.

10.3 Message Frequency

Message frequency varies and depends on your service activity (typically 1–6 messages per service visit). You will only receive messages tied to appointments, repairs, or invoices that you have engaged with us about.

10.4 Message and Data Rates

Message and data rates may apply. Standard messaging rates from your wireless carrier apply to all messages sent or received. Hitec Marine is not responsible for any charges from your carrier.

10.5 Opting Out (STOP)

You can cancel the SMS service at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text message from us. After you send the opt-out message, we will send you a confirmation text acknowledging that you have been unsubscribed and will no longer receive messages from us. If you want to join again, reply START, SUBSCRIBE, or UNSTOP, or sign up again through our service intake.

10.6 Help (HELP)

For help with the SMS program at any time, reply HELP or INFO to any message, email contact@hitecmarine.net, or call (270) 527-1900.

10.7 Supported Carriers and Carrier Disclaimer

The program is available on most major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and is not guaranteed.

10.8 Privacy

For information about how we collect, use, and protect mobile information and SMS opt-in data, see our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
